Warranty Policy Alpha91

Alpha91 Enterprises (Pty) Ltd (herein referred to as “Alpha91”) warrants that each part of the Alpha91 website or shop, shall at the time of delivery conform to the applicable terms and conditions, and that the products and services on the Alpha91 website are direct warrants from Alpha91 in all cases. Products are previously owned (used) and will be free from material imperfections when held at an arm’s length in most cases. The Items may have minor defects which may or may not be noted on each product page.

Product Warranties are only given on key components (listed on our Return policy)

If a product proves defective during the warranty period, Alpha91 Enterprises (Pty) Ltd, at its option, will:

  • Repair the product using telephone support or depot services at no charge for parts or labour, or
  • Replace the product with a comparable product which may be new or refurbished or,
  • Refund the amount paid for the product, less a reasonable allowance for usage, upon return.

Alpha91 Enterprises (Pty) Ltd recommends the Customer first utilize product diagnostics, the information contained on the web, and email support. If unsuccessful, to obtain service under this warranty, the customer must notify Alpha91 Enterprises (Pty) Ltd by telephone or WhatsApp of the defect before the expiration of the warranty period. Customers will provide appropriate assistance to support personnel to resolve the issues.

If telephone support is unsuccessful, Alpha91 Enterprises (Pty) Ltd will instruct the customer on how to receive the warranty repair as mentioned above.

Alpha91 Enterprises (Pty) Ltd reserves the right to charge for service in exception cases.

If the customer’s product contains features that enable Alpha91 Enterprises (Pty) Ltd to diagnose and repair problems with the product remotely, Alpha91 Enterprises (Pty)Ltd may request that the customer allow such remote access to the product.

In the maintenance of the product, Alpha91 Enterprises (Pty) Ltd may use new or equivalent to new parts, assemblies, or products for equal improved quality. All defective parts, assemblies, and products become the property of Alpha91 Enterprises (Pty) Ltd. Alpha91 Enterprises (Pty) Ltd may require the return of parts, assemblies, and products to a designated Alpha91 Enterprises (Pty) ltd depot or the authorized representative from which the part, assembly, or product was originally purchased. Return and claims will be handled according to the current Alpha91 Enterprises (Pty) Ltd procedure.

1) Customer’s and Alpha91 remedies are conditioned upon:

1.1) Discovery of a defect by the customer on a part within 2 (two) calendar days of delivery; and

1.2) Receipt of written notice of a defect, from the customer no later than 2 (two) calendar days after delivery date;

1.3) Prompt return of a defective part at the customer’s expense to Alpha91; and

1.4) Sufficient information to substantiate the customer’s claim. (Return to the customer of the repaired or replaced part will be at Alpha91 expense).

2) Liability

These warranties shall not apply to any defect, failure, or damage caused by improper use or improper or inadequate maintenance and care. Alpha91 Enterprises (Pty) Ltd shall not be obligated under these warranties:

2.1) To perform user maintenance or to repair damage, malfunction, or degradation of performance resulting from failure to perform user maintenance as prescribed;

2.2) Any accident, contamination, foreign object damage, abuse, neglect, or negligence after delivery to the buyer, unless caused by Alpha91;

2.3) Any damage precipitated by any part that was not supplied by Alpha91;

2.4) To Repair damage resulting from attempts by personnel other than Alpha91 Enterprises (Pty) Ltd representatives to install, repair or service the product unless directed by an Alpha91 Enterprises (Pty) Ltd representative;

2.5) To repair damage, malfunction, or degradation of performance resulting from improper use or connection to incompatible equipment or memory;

2.6) If the warranty period is expired or the warranty label is broken or removed;

2.7) To repair an item that has been modified or integrated with other products when the effect of such notifications or integration increases the time or difficulty of servicing the product or degrades performance or reliability;

2.8) To repair damage, malfunction, or degradation of performance resulting from the use of the product in an environment not meeting the operating specifications outlined in the user manual;

2.9) To repair damage, malfunction, or degradation of performance resulting from failure to properly prepare and transport the product as prescribed;

2.10) The defect was subject to Force Majeure, such as acts of God, flood, lightning, earthquake, war, vandalism, theft, brownouts, or sags (damage due to low voltage disturbances). If the customer's product is not covered under warranty, Alpha91 may offer Repair Services under the customer's payment.

2.11) To support software not supplied by Alpha91 Enterprises (Pty) Ltd;

2.12) To provide software or firmware updates or upgrades.

Any service identified in the above list and provided by Alpha91 Enterprises (Pty) Ltd at the Customer’s request shall be invoiced to the customer at Alpha91 Enterprises (Pty) Ltd the current rates for parts, travel, and labour.

3) Exclusion of Liability

The warranties, obligations, and liabilities of Alpha91 and the remedies of the customer outlined in this agreement are exclusive. Customer hereby waives, releases and renounces all other warranties, obligations, and liabilities of Alpha91, and all other rights, claims, and remedies of the customer against Alpha91, express or implied, arising by law or otherwise, concerning any nonconformance or defect in any parts or other goods provided under this agreement or any order, including but not limited to:

3.1) Any warranty of merchantability or fitness; and

3.2) Any implied warranty arising from a course of performance, course of dealing, or usage of trade; and

3.3) Any obligation, liability, right, claim or remedy in tort; and

3.4) Any obligation, liability, right, claim or remedy for loss of or damage to any part. Alpha91 will have no obligation or liability, whether arising in the contract (including warranty), tort, or otherwise, for loss of use, revenue, or profit or any other incidental or consequential damages concerning any nonconformance or defect in any parts or other goods provided under this agreement or any order.

4) Limited Warranty

4.1) Alpha91 warrants its products against defects in material and workmanship. Under normal use and service, every hardware portion of the products will be free from physical defects in material and workmanship during the warranty period, or the product will be repaired or replaced as determined solely by Alpha91. Alpha91 provides a limited warranty for its products only to the person or entity that originally purchased the product through the Alpha91 Online Shop.

4.2) Warranty periods are made available on the customer’s PDF invoices/orders, which will be on your “My Account” page, and on the Return policy. All warranties given to customer’s are considered carry-in warranties, which means that the product must be returned to Alpha91 offices via courier or in person appointment. Under no circumstance will Alpha91 be liable to collect a defective product from the customer.

4.3) If a product does not operate as warranted above during the applicable warranty period, Alpha91 shall, at its option arrange, communicate and mitigate repairs of the defective product or part. Alpha91 replacement products may be new or reconditioned.

4.4) Under no circumstances will Alpha91, its service provider, or either's affiliates, employees, officers, directors or agents be liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable (including but not limited to), claims for loss of data, goodwill, inconvenience, delay, profits, use of money or use of the Alpha91 Online Shop products, interruption in use or availability of data.

4.5) Alpha91 entire liability and customer's sole and exclusive remedy for claims related to or arising out of these terms and conditions for any cause and despite the form of action, whether in contract or tort, statutory or otherwise, including negligence and strict liability, will not exceed the amount of the purchase price paid. This limitation of liability will be effective even if the customer has advised Alpha91 of the possibility of any such damages.

4.6) These terms and conditions give customers specific legal rights. Customers may also have other rights that may vary from state to state or from country to country. customer is advised to consult applicable state or country laws for a full determination of the customer's rights. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of these terms and conditions may not apply to the customer.

5) Repair Service

Warranty and out-of-warranty service should be obtained by contacting Alpha91.

There are no user-serviceable parts inside some of the products and services. Do not allow any unauthorized service centre or personnel to repair or modify the products or interfere with services.

All defective parts, assemblies, and products become the property of Alpha91 Enterprises (Pty) Ltd. Alpha91 Enterprises (Pty) Ltd may require the return of parts, assemblies, and products to a designated Alpha91 Enterprises (Pty) ltd depot or the authorized representative from which the part, assembly, or product was originally purchased. It is the customer's sole responsibility to back up his/ her data. Before allowing any service from Alpha91 or its service providers, including remote login check and repairing service, the customer must back up the data and remove any of the customer's confidential, proprietary or personal information. Neither Alpha91 nor its service provider will be liable for any damage, loss, and exposure of confidential or private information or data contained in any product, hardware, software, or media.
